This is an example of a codicil to a will. If you want to make a change to a will without having to rewrite the whole thing, you use a 'codicil' (pronounced kah-duh-suhl). Generally, it's better to just rewrite the will, but under certain circumstances people may only want to make a small change. In order to make a modification to a will, you should never write on it or scratch something out because these types of actions can invalidate the entire thing. Instead, you need to use a codicil.   1. A Codicil is a legal document that you use to make a minor change (also known as an addendum) to your Last Will and Testament. For instance, you may need to add or delete a clause or change the name of an executor, guardian, or beneficiary. When should I use a Codicil? You should only use a Codicil for minor changes to your Will.
  2. With a codicil, anything can be amended in the Will. Examples include the personal representative, executor, beneficiaries, or any other part of the estate transfer. Make a note of the Sections and language that needs to be changed. It’s required in the Codicil for the specific sections be referenced. Step 3 – Write the Codicil.

CODICIL TO AMEND LAST WILL AND TESTAMENT

Description: This form is a Codicil to amend your Last Will and Testament. It is guaranteed compliant with Oregon law. A Codicil is a document that amends or supplements your existing Last Will and Testament. The advantage to using a Codicil to change your Will is that it allows you to make minor changes to your Will while still keeping your original Will in full force and effect, except for the changes expressly stated in your Codicil. Specifically, using this form, you can:

  • Acknowledge and provide for children born after the execution of your Will;
  • Revoke the appointment of the person currently named as the Executor of your Will and appoint a new Executor;
  • Revoke certain specific bequests currently contained in your Will that you no longer wish to make;
  • Add additional specific bequests not currently contained in your Will that you now wish to make; and
  • Revoke the designation of the person currently named as the Beneficiary of the rest and remainder of your estate and appoint a new Beneficiary.

This Codicil form enables you to make as many or as few of the above mentioned amendments and/or supplements to your Will as you choose. Additionally, this Codicil provides space allowing you to amend your Will in accordance with your specific wishes regarding any other matters not expressly presented as options listed above. You will also receive the appropriate Witness and Notarial Statements required in the State of Oregon.
